By way of this application, the applicant-original accused, pending hearing and final disposal of the criminal appeal, is seeking suspension of the substantive sentence awarded to him by the Additional Sessions Judge, Biloli in Special (ACB) Case No.2/2014 vide judgment and order dated 6.10.2016, whereby the applicant-accused came to be convicted for the offence punishable under section 7 of the Prevention of Corruption Act, 1988 and sentenced to suffer R.I. for three years and further convicted for the offence punishable u/s 13 (1) (d) r.w. 13 (2) of P.C.Act and
sentenced to suffer R.I. for three years and fine of Rs.25,000/-, I.D. to suffer S.I. for six months. 2.
Learned counsel for the applicant submits that, the appeal is admitted by this Court and, during the course of the trial, the applicant-accused was on bail. Further the applicant accused has already deposited fine amount.

I have also heard the learned APP for the State. 4.
Considering the impugned judgment and order and the fact that the applicant accused was on bail during the course of the trial, pending the hearing and final disposal of the criminal appeal the substantive sentence passed by the Additional Sessions Judge, Biloli in Special (ACB) Case No.2/2014 as aforesaid, stands suspended and the applicant accused Udhav Vitthalrao Shinde be released on bail on his furnishing P.B. of Rs.15,000/- (Rs. Fifteen Thousand) with one surety of the like amount.
