Heard the learned counsel for the petitioner and the learned Addl. G. P. for respondent Nos. 1 and 2.

This Court in earlier Writ Petition No. 12631 of 2021 filed by the petitioner under order dated 22.11.2021 had set aside the show cause notice issued to the petitioner to produce validity certificate, else adverse action would be taken and the petitioner would be placed on supernumerary post. In the said order we had directed the committee to decide the proceeding within a period of six (06) months from the date of appearance of the petitioner. The petitioner was directed to appear on 09.12.2021.

Before lapse of said period, the petitioner again is placed on supernumerary post. In view of the earlier order, the respondents ought not to have placed the petitioner on supernumerary post. 4.

The impugned order is quashed and set aside. The parties may abide by the order dated 22.11.2021 passed in Writ Petition No. 12631 of 2021.

Writ petition is disposed of. No costs.
