This matter was heard at length on 21.01.2019 and posted for passing orders on 31.01.2019. A request was made by the learned Advocate for the Respondent/ Management stating that he is likely to receive certain instructions which would settle the dispute in this petition. Today, the learned Advocate for the Respondent/ Management has tendered an original communication dated 31.01.2019 addressed to him stating that the retiral benefits from 22.05.2007 till 31.03.2016, which is the actual date of superannuation of the Petitioner, would be paid by the Management to the extent of pensionary benefits. The learned Advocate for the Petitioner/ employee submits

In view of the above, the original communication dated 31.01.2019 along with the statements as regards the gratuity and earned leave calculation, is taken on record and marked as "X" collectively (total three pages) for identification.

In view of the above, this Writ Petition is disposed of in terms of the statements made in the document at Exhibit X. The statement of the petitioner/ worker that he waives the back wages for the above said period is recorded. He shall now be precluded from raising the said issue before any court, authority or tribunal and the entire issue/ dispute between the Petitioner and the Respondent is now accorded a quietus.
