Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant has been arraigned as an accused for the offence of murder having motive to remove the golden ornaments from the person of the deceased. The prosecution has evidence that the deceased herself went to the goldsmith shop and sold the golden beads. It is alleged against the applicant that she along with co-accused committed the murder of the deceased for golden ornaments. The golden bangles were seen on the person of the deceased. However, the other golden ornaments, which were allegedly taken away are having meager value. The dead body was found third day of

33-BA.1920-22.odt the incident just near the village road. The applicant has no antecedents to her discredit. She was merely helping the deceased, as she was being alone. She has been arrested on 16.03.2022.

3. Considering the investigation papers along with charge sheet, it reveals that the applicant has prima facie case for bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant REKHA D/O. BABURAO KOLPEK be released on bail on furnishing P.B. and S.B. of Rs.25,000/- (Rupees Twenty Five Thousand only) with one solvent surety of the like amount, in Crime No.108 of 2022, registered by Police Station Badnapur, District Jalna, for the offence punishable under Sections 302, 201, 120-B, 394, 404 read with Section 34 of the IPC, on the condition not to tamper with the prosecution witnesses.
