By this writ petition, the petitioner is challenging the order dated 1.9.2017 passed by the Assistant Charity Commissioner, Dhule Region, Dhule in Misc. Inquiry Application No.862/2017.

Learned counsel appearing for respondent no.4 submits that, the pursuant to the impugned order dated 1.9.2017 passed by the Assistant Charity Commissioner, Dhule Region, Dhule, election of Managing Committee has been conducted. It appears that the petitioner as well as respondent no.4 claim that the election of the aaa/-

WP 12616.2017.odt Managing Committee has been conducted separately by them as per the directions given by this Court in first Appeal No.2580/2016. Learned counsel for respondent no.4 submits that, respondent no.4 is also going to file a change report in terms of the elections pursuant to the order passed by the Assistant Charity Commissioner, Dhule Region, Dhule. In view of the above since the change report is already pending before the Assistant Charity Commissioner, Dhule Region, Dhule and respondent no.4 is also going to file change report of the election pertaining to the Managing Committee, it would not be appropriate to interfere in the impugned order passed by the Assistant Charity Commissioner, Dhule Region, Dhule dated 1.9.2017. Both the parties are at liberty to raise all points in the change report. All points kept open. Writ Petition is accordingly disposed of. No costs.
