The applicant is seeking intervention in the writ petition. The locus of the applicant cannot be decided independently. The Municipal Corporation was not a party before the Tribunal. 2.

It reveals from record that applicant-Corporation wants to construct water reservoir. Unless the controversy between the parties is adjudicated, the claim of the corporation cannot be accepted. It would be open for the Corporation to avail any other remedy as is permissible in law. For the first time, Corporation cannot agitate any right, interest or claim in the High Court.
