1] Heard learned counsel for the applicants and the learned APP for the respondent-State.
2] The applicants are seeking bail as they were arrested in connection with Crime No. 426/2022, registered with Gandhi Chowk Police Station, Latur, for the offence punishable under Section 302 r/w. 34 of the Indian Penal Code.
3] The learned counsel for the applicants submits that the Sessions Court, by order dated 12.12.2022 in Criminal Bail Application No.760/2022 and by order dated 01.03.2023 in Criminal Bail Application No.33/2023, has granted bail in favour of the co-accused. The learned counsel for the applicants further submits that no specific role has been attributed to the applicants. All the accused are alleged to have same role in the crime.
4] The learned APP points out that there are four criminal cases filed against the applicant, namely, Rohit @ Angya Prakash Kamble, under Sections 392 and 324 of the Indian Penal Code and there is one criminal case filed against the applicant, namely, Amol @ Mama Bhimrao Jadhav under Section 324 of the Indian Penal Code. The learned APP submits that the applicants are the habitual criminals.
5] Bail Application No.1950 of 2024 in respect of the applicant, namely, Rohit @ Angya Prakash Kamble is rejected. Liberty is granted to the applicant, namely, Amol to revive his bail application after one year, in the event the trial has not proceeded further.
6] The application in respect of the applicant, namely, Amol @ Mama Bhimrao Jadhav, is allowed in the following terms :
a] The applicant in Bail Application No.1952 of 2024 shall be released on bail in connection with Crime No. 426/2022, registered with Gandhi Chowk Police Station, Latur, for the offence punishable under Section 302 r/w. 34 of the Indian Penal Code, on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.
b] The applicant in Bail Application No. 1952 of 2024, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial.
c] The applicant in Bail Application No. 1952 of 2024 shall co-operate with the trial Court and he shall attend each and every date, unless exempted by the trial Court.
d] The applicant in Bail Application No.1952 of 2024 shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and other persons concerned with the case. e] The applicant in Bail Application No.1952 of 2024, upon being released on bail, shall place on
record of the trial Court the details of his Contact Number and residential address with updates in case of any change.
f] The applicant in Bail Application No.1952 of 2024 shall not involve in such type of offence. 6] Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant, namely, Amol @ Mama Bhimrao Jadhav, shall be liable to be cancelled. It is also clarified that the observations made in this order are limited to the disposal of the Bail Application No.1952 of 2024. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.
7] The Bail Application No. 1952 of 2024 stands disposed of accordingly.
