Learned advocate for respondent No. 2 has raised a preliminary objection about maintainability of the present petition on the ground that the petitioner has alternate remedy of filing appeal under section 249 of the Maharashtra Land Revenue Code.

Learned advocate for the petitioner, therefore, on instructions, seeks permission to withdraw the petition with liberty to file the appeal.

Permission granted. Writ petition is disposed of as withdrawn with liberty as prayed for.
