This Civil Application is preferred to bring on record legal heirs of the deceased respondent viz. Tanaji Shivaji Palange. It is contended that respondent has expired on 23.07.2018. Present application is presented on 19.10.2018. The application is within stipulated time under the Law of Limitation.

By virtue of Chapter II Rule 3 sub-rule (i), the Registrar is empowered to decide the applications for entering on the record the names of the legal representatives of the deceased parties which are presented in time and/or in which there is no contest. Having regard to the factual aspects, coupled with provisions under Chapter-II of the Bombay High Court Appellate Side Rules, it would be just and proper to 9 CIVIL APPLICATION NO.8818 OF 2019

allow the Civil Application and direct the appellant/applicant to carry out necessary amendment within the stipulated period. In turn, I pass the following order.

ORDER

Civil Application No.8818/2019 is allowed in terms of prayer clause (B).

The appellant shall carry out amendment within period of fourteen days without fail.
