DATED : 8 th January, 2015 PER COURT :- 1] This is a Writ Petition filed by the petitioner. Prayer clause 'B' of the petition reads as under :- "(B) The Honourable High Court may kindly be released the applicant on regular bail, in Crime No.1-50/2011 registered on 8/3/2011 u/s 3(1)(ii), 3(2), 3(4), 3(5) of MCOC Act and under section 395 of Indian Penal Code with Police Station, Omerga, District Osmanabad, on such terms and conditions which this Honourable Court deems fit and proper and for directions."

2] In the prayer clause 'C' the applicant has also sought direction to dispose of the case pending

crwp1448.14 before the court as early as possible.

3] In so far as prayer clause 'B' is concerned, the petition is totally misconceived.

4] The petitioner has to file an application for bail before the appropriate court under the appropriate provisions of law. Hence prayer clause 'B' is rejected. So far as prayer clause 'C' is concerned, on 15.12.2014 this court called the report from the Presiding Officer in whose court the case is pending. Report is received. I have perused the report. Perusal of the report shows that accused persons are trying their best to prolong the stage of framing of the charge. No fault can be found on the part of the prosecution. Hence, Criminal Writ Petition is rejected.
