DECEMBER 12, 2025 ORDER :- The applicant has approached this court seeking withdrawal of amount deposited pursuant to the order dated 06.05.2024, passed by this Court in Anticipatory Bail Application No.707 of 2024, whereby, the applicant was granted interim relief. The Anticipatory Bail Application of the applicant was, thereafter, disposed of as withdrawn vide order dated 28.08.2024.

Learned counsel for the applicant places on record a copy of the order dated 31.10.2025, passed by learned J.M.F.C. (Court No.3), Ambajogai, Dist. Beed, whereby the applicant has been granted regular bail in the aforesaid crime No.74 of 2024 and the affidavit filed by the complainant and other agriculturists, wherein they have contended that the applicant has repaid the amount which was due to him. The

29-crappln3813.2025 copy of the order along with affidavit of the complainant are taken on record and marked as "X" for identification. Learned counsel for the applicant submits that the applicant has repaid the entire amount to the complainant.

Learned APP submits that appropriate order may be passed.

Taking into consideration that the applicant was directed to deposit Rs.2,50,000/- only with an intention to show his bona fide; and the fact that subsequently, the applicant has been granted regular bail by learned J.M.F.C. (Court No.3), Ambajogai, Dist. Beed, in the aforesaid crime No.74 of 2024; so also in view of the affidavit filed by the complainant in the trial court, I see no impediment in allowing this application for withdrawal of amount. 5.

Hence, the applicant is permitted to withdraw the amount of Rs.2,50,000/- deposited in this court pursuant to the order dated 06.05.2024. The application stands allowed and disposed of accordingly.
