The learned counsel for the applicant, on instructions, seeks leave to withdraw this application with liberty to file appropriate application before the District Court at Shrirampur, District Ahmednagar.

In view of Section 388 of the Indian Succession Act particularly proviso 3, permission to withdraw the application is granted with liberty to file an application for condonation of delay and appeal before the proper forum is granted. The application is disposed of accordingly.
