The proceeding is filed for seeking directions to the Honourable Minister, which is Urban Development for expeditious disposal of the appeal filed against the decision given by the Collector, Osmanabad in a proceeding filed for disqualification under Section 44 of the Maharashtra Municipal Councils Act, 1965. It appears that the interim relief is given by the Honourable Minister and due to that, the disqualification is stayed. In view of this circumstance, the Petitioner is interested only in seeking direction of expeditious disposal. The learned counsel for the Respondent, Appellant from the said proceeding, submitted that a direction is

920 wp.10823.16.odt sought and so the matter needs to be taken before the Division Bench. This contention is not acceptable. The direction is sought against the authority, which is expected to exercise quasi judicial powers and ultimately the matter will come to this Court. All the other sides have appeared. Their appearance is taken on record. The Honourable Minister is expected to dispose of the matter within three months from today.

Writ Petition stands disposed of.
