Versus

The State of Maharashtra and others .. Respondents Shri Sanket S. Kulkarni, Advocate for the Petitioner. Shri K. N. Lokhande, A.G.P. for Respondent Nos. 1 to 4. Respondent No. 5 served.

CORAM : S. V. GANGAPURWALA & A. M. DHAVALE, JJ.

DATE : 15 th February, 2018 PER COURT :

1.

Mr. Kulkarni, learned Advocate for the petitioner submits that the petitioner has completed postal D.Ed. On 2nd February, 2017. The time limit is extended up to February - 2019, under Government Resolution dated 9th February, 2016. The learned Advocate further submits that the strength of the student is increased, naturally the posts have also been increased. 2.

Learned Assistant Government Pleader submits that the petitioner was required to complete his D.Ed. within three years.

2 wp 2256.17 As he has not completed within three years the order is correctly passed. Even the post of the petitioner is not admissible. 3.

We have considered the submissions.

4.

The petitioner now claims to have completed D.Ed. and has acquired D.Ed. qualification. The petitioner also contends that in view of increase in strength of students the posts have also increased and the post is admissible to the petitioner. 5.

Considering the above, the Assistant Commissioner, Social Welfare, Osmanabad shall re-consider the case of the petitioner for approval, considering that the petitioner has completed D.Ed. The Assistant Commissioner shall consider the admissibility of the post and take fresh decision accordingly. The impugned order would not be an impediment for the authority to take fresh decision.

6.

The writ petition is accordingly disposed of. No costs. [A. M. DHAVALE, J.] [S. V. GANGAPURWALA, J.] marathe
