This is Application for withdrawal of entire amount deposited by the State in the Appeal.

The learned Advocate for the Applicant submits that, this Application is by the Orig. Claimant for withdrawal of the amount deposited by the Appellant - State. He invited my attention to the order dated 18.11.2025 passed by this Court in connected group of Appeals permitting the Claimants therein to withdraw the entire 100% amount out of which 75% amount is allowed to be withdrawn on furnishing undertaking and 25% amount is allowed to be withdrawn on furnishing solvent surety / Security to the satisfaction of the learned Registrar (Judicial) of this Court. He submits that, the Application be allowed. 3.

Though the learned AGP opposes the Application, she does not dispute the above referred order passed in the connected Appeals filed by the State.

Five References were decided by the common Judgment and Award dated 01.01.2013. The State has preferred the Appeals in all the References decided by the said common Judgment and Award. The copy of the order dated 18.11.2025 shows that, this Court has permitted the Claimants therein to withdraw the entire amount. Hence, the following order is passed.

ORDER

(i) The Application is allowed in terms of the order dated 18.11.2025 passed in Civil Application No.12496 of 2025 in First Appeal No.1580 of 2024 with connected Applications. (ii) The Applicant is allowed to withdraw 100% amount, out of which 75% amount with accrued interest thereon is allowed to be withdrawn on furnishing regular Undertaking and 25% amount with accrued interest thereon is allowed to be withdrawn on furnishing Solvent Surety / Security to the satisfaction of the learned Registrar (Judicial) of this Court.

(iii) The Application stands disposed off.
