BENCH AT AURANGABAD.

937 WRIT PETITION NO. 2423 OF 2017 TAHAWARA BEGUM AFSAR KHAN

VERSUS

ANWARKHAN NOORUDDIN KHAN SAHEB ...

Advocate for Petitioner : Mr. R.R. Shaikh ...

CORAM : S. B. SHUKRE, J.

Date: February 28, 2017 ...

PER COURT :- Heard.

Upon going through the impugned order, I do not see any illegality or perversity therein. Learned Judge has rightly observed that, exhibiting a document does not by itself mean that, the document is proved in evidence and that in any case, such a document, before it is read in evidence, would have to be duly proved in accordance with provisions of law. Therefore, it is always open for the petitioner to show at the time of final hearing that, this document in respect of which the application vide Exh. 46 has been filed, was not proved in accordance with law.

With these observations, the petition stands dismissed summarily.
