In all these Applications, the common question arises that whether the delay which has been caused while lodging the appeals, can be condoned. Therefore, all these Applications are being heard together.

Having regard to the submissions canvassed on behalf of both the sides, I have gone through the record. The present Applicant is the Acquiring Body, has filed the present Applications and prayed for condonation of delay of 262, 263, 258, 262, 263, 258 days, respectively, caused while lodging the appeal against the judgment and award passed by the learned Joint Civil Judge, Senior Division, Kandhar.

The Appellant Acquiring Body submitted that after the award is passed by the Reference Court, immediately, the file was moved for legal opinion. However, the delay caused for receiving the legal advise as well as the payment of Court fees, which appears to be bona fide and substantial. Therefore, the delay caused in lodging the appeals, is hereby condoned. All the Civil Applications are disposed of.
