Heard the learned Advocate for the Applicants, learned AGP for Respondent Nos.1 and 2 - State and the learned Advocate for Respondent No.3 - Acquiring Body.

This is an Application for withdrawal of the amount deposited by the Acquiring Body in this Court in the Appeal preferred by the Acquiring Body against the common Judgment and order / award dated 28/07/2011. 3.

Attention of this Court is drawn to the order dated 05/08/2025 passed in Civil Application No.8251/2025 in First Appeal No.1266/2024, arising out of the same proceedings and the same common Judgment, permitting the Claimants therein to withdraw the entire 75% amount along with the interest accrued thereon. The parties are ad idem to pass the same order.

Hence, the Application is allowed. The Applicants are permitted to withdraw the deposited amount, i.e. 75% of the amount under the Award, along with the interest accrued thereon, subject to furnishing regular undertaking to the satisfaction of the Registrar (Judicial) of this Court. 5.
