Heard learned counsel for the parties. For the reasons contained in the Civil Application, despite stiff resistance on behalf of the appearing respondents, I deem it appropriate to grant the same. As such, Civil Application No.15020 of 2013 stands granted in terms of prayer clauses (B) and (C) and is allowed accordingly and disposed of. 2.

So far as Second Appeal No.162 of 1992 is concerned, issue notice to such of the legal heirs of respondent no.1-A, for whom Mr. Mukhedkar has not put in appearance in the Civil Application for bringing legal heirs on record and condonation of delay, returnable on
