Gangabai Saylu Jajulwar And Another v. Bhoyabai Fakir Pogdapalli And Others
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.11941 OF 2016 (Gangabai Saylu Jajulwar and another Vs. Bhogyabai Fakir Pogdapalli and others) Mr.M.D.Narwadkar, Advocate for the petitioners. Mr.A.M.Gaikwad, Advocate for respondent Nos. 1 to 3. ( CORAM : Ravindra V.Ghuge, J.) DATE : 12/07/2017 PER COURT :
1.
This matter was extensively heard on 07/07/2017. I had expressed a view to the learned Advocates that I would not be causing interference in the impugned judgment of the Appeal Court dated 27/09/2016 by which the order dated 21/11/2015 passed by the Trial Court clamping injunction under Order 39 Rule 1 and 2 against the petitioners was sustained.
2.
The petitioners were called upon to make a statement as to whether they would maintain status-quo keeping the said orders in view and the suit could be expedited. Learned Advocate for the petitioners submits on instructions that the petitioners would maintain status-quo as existing today keeping in view the orders passed by the Courts below.

3.
Considering the above, this petition is disposed of without causing interference in the impugned orders. The litigating sides would maintain status-quo with regard to the suit property as existing today. The Trial Court shall endeavour to decide RCS No.76/2014, as expeditiously as possible, and preferably within one
(1) year from today.
