The tribe claim of the Petitioner as Thakur, Scheduled Tribe is invalidated.

The learned Counsel submits that the Petitioner had never got an opportunity to controvert the contra entries on record. The Petitioner also could get the record of Yashwant. The said certificate issued shows that his tribe was recorded as Thakur and his son's caste cannot be recorded contra. The learned Counsel submits that no opportunity was given to the Petitioner to controvert the documents which the vigilance had found. The Petitioner had also not got an opportunity to place on record the school record of Yashwant.

We have also heard the learned A.G.P.

The matter pertains to the social status of the Petitioner, we are inclined to grant one opportunity to the Petitioner. In the light of that, the impugned Judgment and Order is quashed and set aside. The matter is relegated before the Committee. The Petitioner shall appear before the Committee on 10.12.2021. The Petitioner may place on record the additional documents on which the Petitioner places reliance and may also file say controverting the averments. The Committee may conduct vigilance of documents that may be produced by the Petitioner. The Committee shall, thereafter, decide the proceeding preferably within three (03) weeks from the date of appearance of the Petitioner.

Writ Petition accordingly stands disposed of. No costs.
