( 2 ) policy decision taken by the State Government in its Government Resolution dated 3rd November, 2016, as amended from time to time.

Accordingly, learned counsel for the acquiring body to take instructions as to whether these appeals are to be proceeded with or not. Sd/- [M.S.SONAK, J.]"
2) Today, when the matters are called out, Mrs.Vaishali D.Jadhav learned counsel for the appellant placed on record communication dated 15.1.2018 addressed to her by the Executive Engineer, Minor Irrigation Division, Dhule, duly instructing her to withdraw these appeals because the enhancement amount involved in these appeals is well within the limits prescribed in the Government Resolutions dated 3.11.2016 and 23.2.2017. On the basis of such written instruction, Mrs.Jadhav learned counsel for the appellants seeks leave to withdraw these appeals. The copy of the communication dated 15.1.2018 is taken on
( 3 ) record and marked as Exh.X for the purpose of identification.
3) Leave is granted and these appeals are disposed of as withdrawn.
4) Civil Applications, if any, do not survive and the same are also accordingly disposed of.
5) The appellant shall be entitled for refund of Court fees as per the Rules.
