Mr. Lale, the learned counsel for the petitioner submits that, the petitioner was kept in wait list for the post of Block Mission Manager. The vacancy still exists. Subsequently a fresh advertisement was issued without considering the petitioner for appointment. According to the learned counsel, the same is illegal. The qualification has been changed subsequently by the respondents. The petitioner possesses the qualification of B.Sc. 2.

Mr. Pulkundwar, the learned AGP submits that, the petitioner did not possess the qualification as required under the advertisement. The petitioner did not apply pursuant to the fresh advertisement also.

We cannot consider the grievance of the petitioner seeking appointment to the post of Block Mission Manager as the petitioner did not possess the qualification as required under the advertisement. We cannot direct the respondents to appoint the person who does not possess the qualification as is detailed in the advertisement. The petitioner has also not applied pursuant to the fresh advertisement.

In light of the above, no relief can be granted to the petitioner. The writ petition stands disposed of. 5.

In view of disposal of the writ petition, civil application also stands disposed of. No costs.
