DATED : 3rd FEBRUARY, 2017 PER COURT:- Learned counsel for the applicants submits that despite the direction given by this Court, 50% of amount under award is not deposited and only an amount of Rs.2,58.590/- is deposited against the award of Rs.8,00,000/-. Learned counsel for the applicant submits that the applicant insurer has deposited entire amount as directed by the Tribunal alongwith interest and the same has been withdrawn by the respondent claimants. Since respondent owner has not deposited 50% of the amount under award and further no steps to deposit the remaining amount is taken, the applicant is permitted to withdraw the amount deposited in this Court. Civil application is allowed in terms of prayer clauses "B" and "C" and disposed of. ( V. K. JADHAV, J.) rlj/
