Heard both the sides. Considering the challenge made to the judgment and award passed by the tribunal. The applicant is permitted to withdraw 50% of the amount on furnishing undertaking to the satisfaction of the Registrar (Judicial) on the ground that the injury sustained by applicant resulted into permanent disablement to the extent of 35% and the applicant has incurred the medical expenses. Civil application is accordingly disposed of.
