Heard learned counsel for petitioner.

Learned counsel points out that it is the father of present petitioner who has been her power of attorney holder including power for withdrawal of amount paid / deposited towards maintenance. He submits that while interim maintenance had been granted, the same had been withdrawn by father of the petitioner as her power of attorney holder. Power of attorney holder being the father, the apprehension expressed by court in this particular case would not have any credibility and substance.

Learned counsel further submits that the amount, in such a case, can be paid to petitioner - erstwhile wife, deposited by

WP-1638-19.doc her erstwhile husband through banker's cheque, demand draft or can be directly transferred in petitioner's Indian bank account through Real Time Gross Settlement (RTGS) or National Electronic Funds Transfer (NEFT).

In the circumstances, the amount deposited by erstwhile husband of petitioner towards permanent alimony and maintenance may be disbursed to petitioner through crossed bank cheque or crossed demand draft or through RTGS in Indian bank account of petitioner after due verification of that the account in the bank is that of the petitioner. 5.

Petition is accordingly disposed of.
