Heard finally with consent of the parties at admission stage. 2.

Learned A.P.P., on instructions in writing from the investigating officer who is present in person before the Court, submits that the Deputy Engineer (Water Supply) (in-charge of the post of Executive Engineer at the relevant time) is now added as accused No.2 in connection with crime No. 565 of 2021 registered with Kranti Chowk police station, Aurangabad. 3.

Though learned counsel for the petitioner has vehemently submitted that other two contractors viz. M/s. Ruchita Constructions and M/s. Sai-Ishwar constructions have also comitted crime in the similar manner, however, on careful perusal of the inquiry report brought to our notice by the learned A.P.P. from police papers, it appears that their proposals were never scrutinized and verified in any manner. Learned counsel for the petitioner has also failed to point out single document annexed to the representation to indicate their involvement in the similar manner as of accused contractor Bhagwan Vilas Avahad.

At this stage, learned counsel for the petitioner, on instructions, submits that the petitioner is withdrawing all charges levelled against those two contractors viz. M/s. Ruchita Constructions and M/s. Sai-Ishwar Constructions.

In view of above, since the purpose of filing this writ petition is over, the same hereby disposed of.
