The learned Counsel for the applicants submits that the reference Court has decided the reference petition without giving sufficient opportunity to the applicants - original claimants to lead oral and documentary evidence.

The learned Counsel further submits that the applicants have no knowledge about the decision given in the pending Land Acquisition Reference and, therefore, the delay occurred. 3.
Learned A.G.P. has strongly resisted the application. He submits that the delay is not properly explained. 4.
In view of the submissions made on behalf of applicants and for the reasons stated in the application, the delay of 1060 days caused in filing the appeal is hereby condoned.
