This is the Application by the Claimants / Applicants to give paper publication in the daily newspaper inviting Legal Heirs of Deceased Respondent No.1 - Dadarsing Kashmirsingh Hanspal who was the owner of the vehicle involved in the motor vehicular accident. He submits that, though diligent steps were taken by the Applicants to know the names and details of the Legal Heirs of Deceased Respondent No.1, they could not succeed and hence, this Application to invite them in this Appeal by way of paper publication.

The papers on record go to show that the Applicants /Appellants were the Original Claimants before the learned Motor Accident Claims Tribunal. Their claim came to be decided by the Judgment and Award dated 17.12.2018 in M.A.C.P No.232/2017. Conditional order was passed on 20.09.2024 to take appropriate steps in respect of Respondent

No.1 within four (4) weeks. It appears that this Application is filed before the expiry of four (4) weeks period. It appears that there is wrong endorsement by the Office that the Appeal stands dismissed as against Respondent No.1 due to non compliance of the conditional order. In this view of the matter, the Application is allowed in terms of prayer clause '

B'. The paper publication be given in a newspaper having wide circulation in Nanded District. Paper publication be done within a period of four (4) weeks. The Application stands disposed off accordingly.
