Today the learned advocate for the appellant place on record affidavit executed by the appellant-original complainant stating that the appellant does not want to proceed with the appeal. The affidavit is taken on record and marked as 'X' for identification.

On looking to the record it is seen that respondent was acquitted for the offence punishable under Section 420 of the Indian Penal Code against which the appeal was preferred in

(2) criapl770.19 the learned Sessions Court wherein said criminal appeal came to be dismissed as not maintainable. It is against that the appellant has approached this court. Since the appellant does not want to proceed a request is accepted.

In view of above, the appeal stands disposed off for want of prosecution.
