This is the Application for condonation of 1673 days delay in preferring the First Appeal by the Orig. Claimant against the Judgment and Award passed by the learned Reference Court. 3.

Heard the learned Advocate for the Applicant and the learned AGP for the Respondents. Perused the Application and the papers enclosed therewith.

For the reasons mentioned in the Application, the aforesaid delay can be condoned, subject to the condition that the Applicant shall not be entitled for statutory benefits and interest for the delayed period. Hence, the following order.

ORDER

(i) The Application is allowed in terms of prayer clause 'B' subject to condition that the Applicant - Appellant shall not be entitled for the interest and the statutory benefits for the delayed period.

(ii) The Applicant - Appellant shall file undertaking in above terms.

(iii) The Application stands disposed off.
