O R D E R

This appeal is placed before us in today's National Lok Adalat. Mr.V.S. Badakh, learned Advocate for the appellants/original claimants and Mr.S.S. Rathi, learned Advocate for the insurance company are present. 02.

Appellant Nos.1,2 and respondent No.3 are original claimants. However, while filing the appeal, only appellant Nos.1 and 2 were available for signing Vakalatnama. Therefore, respondent No.3 though is original claimant, has been arrayed as respondent in this appeal. The appellants and respondent No.3 are entitled to receive amount of compensation. Appellant No.2 and respondent No.3 have filed a letter on record authorizing appellant No.1 to withdraw/accept the amount of compensation. The pursis is taken on record and marked "X" and the letter by appellant No.2 and respondent No.3 is taken on record and marked as "X-1".

In view of this the compensation amount be transferred in the name of appellant No.1 alone. After the compensation amount is deposited, appellant No.1 is at liberty to withdraw the entire amount of compensation on her behalf and on behalf of appellant No.2 and respondent No.3. 04.

The appeal is disposed off in terms of compromise ("X"). 05.

The respondent/insurance company shall deposit the amount of compensation awarded by MACT, Ahmednagar within a period of six weeks from today in terms of compromise before this Court. 06.

The Office of this Court shall adjust that statutory amount and amount if any, withdrawn earlier, in the amount of compensation and thereafter take necessary steps for making the payment. 07.

The court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959.
