The learned APP tenders across the bar affidavit in reply. The order of which the petitioner has been alleging disobedience, reads as under :

"1.

The petitioner, who claims to be illiterate, submits that his father was a Hathyari Police Constable bearing Buckkal No. 182, from July 1947 in the Bombay Police, District at Nanded. He passed away on 12.06.1978. The petitioner, who is 61 years of age today, desires to obtain the service book of his father after 44 years, since his daughter desires a tribe certificate. 2.

Considering the above, this petition is disposed off. 3.

We would call upon respondent no.2 to make an attempt to trace out the service book of the father of the petitioner, namely, Mohammad Hussain s/o Mohammad Babansab. If the service book is traced out, a copy may be handed over to the petitioner by following the due procedure laid down in law. If, for any reason, the service book is not traceable, the petitioner would be informed accordingly. We expect the said exercise to be completed by respondent no.2, on or before 15.03.2023."

The affidavit in reply expressly mentions that in spite of such, the service book is not traecable. It was of the year 1978 and the petitioner has been informed accordingly.
