IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 9921 OF 2013 Ram Anurath Shinde and another ...PETITIONERS versus The State of Maharashtra and others ...RESPONDENTS .....
Mr. V.B. Jadhav, Advocate for petitioners Mr. N.B. Patil, AGP for respondent No. 1 Mr. Ahwin V. Hon, Advocate for respondent No. 4 Mr. U.V. Wagh, Advocate for respondent No. 5 .....
CORAM : S. V. GANGAPURWALA AND K.K. SONAWANE, JJ.
DATED : 21st JUNE, 2016.
Order :-
1. The petitioners have assailed communication dated 29-10-2013 issued by respondent - Bank stating the the petitioners are ineligible to the 'Death Waiver Scheme.'
2.
Learned counsel for the petitioners submits that said communication was issued on the basis of letter issued by the Commissioner of Co-operation dated 16-09-2013. Respondent - Bank had challenged said communication by filing revision under section 154 of the Maharashtra Co-operative Societies Act, 1960 before the Honourable Minister and said letter is stayed vide order dated 28-08-2014.
3.
In light of above, as dispute is pending before Honourable Minister and prohibitory orders are already passed, it would not be appropriate to consider the grievance of the petitioners in the present
2 WP-9921.13 writ petition.
4.
The parties naturally would be governed by order of the Honourable Minister in the revision filed by the respondent-Bank. 5.
In case, said revision is decided, then parties are at liberty to take further steps as may be permissible in law with regard to decision of the Honourable Minister.
6.
Writ petition accordingly stands disposed of. No costs. Sd/- Sd/- [ K. K. SONAWANE, J.] [S. V. GANGAPURWALA, J.] MTK
