This Court by order dated 17th April, 2023 has directed the Assistant Superintendent, Civil Court, Gangapur to verity the compromise terms and signatories thereto. Report dated 24/04/2023 is filed stating that all signatories to the compromise were present before him and he has verified their identity. He also stated about interpreting the terms of compromise to the parties in the language known to them. The said report is taken in record and marked as 'X' for identification. Compromise terms of settlement are taken on record and marked as 'Y' for identification.

Having regard to the nature of suit and the comprise arrived at between the parties there is no impediment and accepting the same being voluntary. Hence Second Appeal No. 689 of 2015 is disposed of in 901.sa689.15.odt

following terms.

(i) R.C.S. No. 202/2009 is decreed in terms of settlement 'Y'.

(ii) Decree be drawn accordingly. Parties bear to their own costs.
