The applicant herein is the original complainant in criminal case instituted otherwise than on police report. The prayer in the application was for taking action under Section 156(3) of the Code of Criminal Procedure. It appears that the learned Special Judge has passed the order, "Issue notice to the respondents" (proposed accused). Such order could not have been passed. The same is hereby set aside, remanding the matter back to the Special Judge to deal with it in accordance with law. 2.
