IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 57 CONT. PETITION NO. 579 OF 2017 IN CRI. WP/860/2017 RAGHUNATH BAPU GAVADE
VERSUS
STATE OF MAHARASHTRA THROGH SP. OF JAIL OPEN PRISON, PAITHAN AND OTHERS ...
Advocate for Petitioner : Mr. Jaiswal Rupesh A. AGP for Respondents/State : Mr. D.R. Kale ...
CORAM : S.S. SHINDE & MANGESH S. PATIL, JJ.
DATE :
14.11.2017 P.C. :- .
During the pendency of the present contempt petition decision has been taken by respondent no.1 on 10.11.2017 about the grievance raised in criminal writ petition no. 860 of 2017. 2.
The fact that now decision has been taken is not in dispute. It is true that the decision has not been taken within four weeks from 03.07.2017 as ordered by this Court. However, the Hon'ble Supreme Court in the case of Suresh Chandra Poddar vs. Dhani Ram and others; (2002) 1 SCC 766 has taken a view that even where the order of court is complied with, subsequent to receipt of notice of contempt,
( 2 ) 57 cp 579.17 court should show judicial grace and magnanimity in dealing with action for contempt.
3.
In that view of the matter, contempt petition stands disposed of.
