Heard learned Advocate for petitioner. Learned AGP waives notice for respondent No.1. No necessity to issue notice to respondent Nos.2 and 3, at this stage.

It has been submitted on behalf of petitioner that when the proposal was submitted for approval of appointment of petitioner by respondent Nos.2 and 3, without calling for removal of defects which were allegedly found by respondent No.1 directly the proposal has been rejected

937_WP_14384_2025 by impugned order dated 06.10.2025.

We are of the opinion that whenever such defects are found an opportunity should be given by Education Officer for curing those defects. Directly action of rejection cannot be taken and, therefore, we set aside the impugned order dated 06.10.2025 passed by respondent No.1. Respondent No.1 should communicate the defects, if any, to respondent Nos.2 and 3 within a period of 15 days and should give sufficient time to respondent Nos.2 and 3 to cure those defects and after hearing the petitioner / respondent Nos.2 and 3 should take the decision on the said proposal.
