The petitioner aggrieved by the order passed by the trial Court, thereby rejecting his application Exh. 142 for calling the City Survey Officer as a witness. The petitioner wanted to bring on record that C.T.S. Number 522 and 523 and 423A are in existence since long.

The application is rejected by the trial Court on the ground that the documents on which the petitioner is proposing to bring on record, through City Survey Officer, the public documents and the petitioner can easily produce them and for that purpose there is no necessity to call the City Survey Officer as witness. 3.

The approach of the trial court is proper. The Trial Court

904wp4655.22 has already observed that the petitioner is at liberty to produce the public documents on record. There is no legality, perversity in the order passed by the trial Court. There is no substance in the petition, the writ petition therefore is dismissed.

No costs.
