DATE : 19.01.2022 PER COURT :- The appellant has taken out this application for setting-aside the order dated 10.02.2021 of this Court and ultimately for restoration of delay condonation application along with appeal. It reveals that conditional stay was initially granted by this Court vide order dated 20th September, 2019. However, as the amount was not deposited, at the request of the appellants, vide order dated 10th February, 2021, the Court has extended time by twelve weeks, with a rider that, on failure the application for delay would stand disposed without reference to the Court.

In turn as the appellant failed to comply the order within stipulated period, the application was disposed. 3.
Thus the main ground for disposal was non compliance of the order. As per submission of learned Assistant Government Pleader, with leave of this Court, the appellant has deposited the entire decretal amount with this Court on 29th November, 2021. Since the entire decretal money is said to be deposited in this Court, the delay condonation application along with this appeal is restored by recalling the direction passed by this Court dated 10.02.2021.

Application stands disposed of accordingly.
