[2] The learned counsel for the Applicant has placed on record copy of order dated 9th January, 2015 passed by this court in Criminal Application No.6355 Of 2013. Same is taken on record and marked as "X" for identification purpose.

[2] The learned counsel for the Applicant submitted that, in fact, two cheques were issued by the present Respondent, out of which, two separate proceedings had arisen. Criminal Application No.6355 Of 2013 was filed for condonation of delay and for leave to prefer

2/2 cri.appln. 6305.15 in cri.appln. 6304.13..sxw Appeal, as regards one cheque. This court had admitted the Criminal Appeal.

[3] Considering all the evidence on record and finding that, present proceedings have also arisen out of the same proceedings, between the same parties, leave to file Appeal is granted. Application is allowed and disposed of. Office to register the Criminal Appeal as per due procedure of law and upon registration of the Appeal, the same stands admitted.

[4] The learned trial court to take action under Section 390 of the Code of Criminal Procedure against Respondent - Shankarlal Madanlal Pallod. The Respondent be released on bail upon executing PR bond of Rs.15,000/- (Rs. Fifteen Thousand only) and furnishing surety in the like amount, in case he binds himself to appear in this court on the next date i.e. 15/10/2015 and thereafter. [M.T. JOSHI, J.]
