Present civil application is filed for extension of time of two months to decide the proceedings as per the order dated 17.08.2021.

It is for the authority to file the civil application for extension of time to decide the proceedings and not a private party.

Mrs. Kulkarni, the learned advocate for the applicant submits that, the Sub Divisional Officer is not affording opportunity of hearing to the applicant.

In para No. 4 of the order dated 17th August, 2021, we have specifically observed that the competent authority shall take decision on the objection of the petitioner on its own merits, in accordance with law and policy, "after giving opportunity of hearing to all the parties."

The said order clarifies opportunity of hearing has to be given to all the interested parties.
