After hearing learned Counsels for both sides, when this Court has shown inclination to cause interference in the impugned order, learned Counsel for contesting Respondents, on instructions, records no objection for setting aside the order impugned and relegating back the matter to the School Tribunal, Nashik for decision of Appeal No. 69/2013 afresh. 2.

In view of the above, instead of passing any order on merit, by consent of both sides, impugned order is set aside. Appeal No. 69/2013 is relegated back to the School Tribunal, Nashik for decision afresh.

Having regard to the fact that Appeal is of year 2013, School Tribunal is directed to dispose of said Appeal within a period of six months from today. 4.

It is clarified that all points raised by the parties in the Petition so also any other point sought to be raised are kept specifically open.
