PER COURT :- The petitioner is raising objection to the order passed by the Civil Judge, Senior Division, Latur dated 11.11.2008 in Regular Civil Suit No.624 of 2008.

The petitioner, in fact, does not appear to have availed of remedy of presenting an Appeal, challenging the decree, in stead, he is seeking stay to the execution and operation of the decree in the present Writ Petition. Prima facie, the petition is not maintainable and stands rejected.

It would be open for the petitioner to avail of the remedy available in law and instant order will not be an impediment in consideration of such an appeal.
