By this petition under Article 226 of the Constitution of India, the petitioners have sought to quash letter/ order dated 9/11/2020, issued by the respondent No.4 Chief Executive Officer of the Bank, who has commenced the enquiry which was initiated on the basis of the complaint made by the petitioner.

A perusal of the decision dated 9/11/2020 reveals that an enquiry was closed in view of the order passed by this Court in Writ Petition No.1020/2020 and crime has been

registered in respect of the said complaint. Since the complainant was only seeking penal action and the crime is already registered in respect of the same incident, we do not find any illegality in closure of the said enquiry. 3.

Learned counsel for the petitioner states that, the said crime is registered pursuant to the First Information Report lodged by the Bank Officer. Suffice it to say that, if at all the petitioners are aggrieved persons, they can give their statements and the investigating officer is bound to record their statements.
