PER COURT :- 1.

The learned counsel for the petitioner submits that, the validation proceedings in respect of the Tribe Claim of the petitioner was pending with the Committee since 2011. However, the same is returned back by the Committee without deciding the same.

We do not find any document on record showing that the Committee has returned back the proposal for any reasons. There is nothing on record to accept the contention of the petitioner. 3.

However, in case the validation proceedings in respect of the Tribe Claim of the petitioner was filed and is not decided or is returned back then the petitioner may file the proposal for validation of his Tribe Certificate to the Committee. The Committee shall accept the said proposal, if, the application is complete in all respects and in accordance with law. On receipt of

2 WP2791.16 the same the Committee shall decide the same on its own merits. This order is passed on the basis of the contention of the petitioner that the validation proceedings are not decided and returned back.

The writ petition is disposed of. No costs.
