The applicant seeks transfer of Hindu Marriage Petition A No.130 of 2023 pending before Family Court, Buldhana to Family Court, Dhule.

Ms. Jakhade, learned advocate appearing for applicant submits that marriage between applicant and respondent was solemnized on 16.11.2016 at Buldhana. The couple is blessed with two children out of matrimonial relationship. The respondent/husband has filed Hindu Marriage Petition A No.130 of 2023 seeking decree of dissolution of marriage before Family Court at Buldhana. The applicant is presently residing along with her parents at Dhule and it would be difficult for applicant to attend proceeding at Buldhana, particularly when she is taking care of two minor children. Although notice of this application is served upon respondent and appearance is caused through Advocate Ms. Pallavi Shrivastav, the application is not contested. Learned advocate
904-mca-27-2025.odt (2) appearing for applicant has placed on record a communication/written note given by Advocate Ms. Pallavi Shrivastav wherein it is stipulated that respondent has no objection if proceeding is transferred to Family Court at Dhule. Even otherwise, looking to the law laid down by the Hon'ble Supreme Court in case of N.C.V. Aishwarya Vs. A.S. Saravana Karthik Sha reported in AIR 2022 SC 4318, convenience of wife has to be given precedence over convenience of husband. Looking to the distance between Dhule and Buldhana, the applicant/wife would definitely face inconvenience in attending the proceeding.

In that view of matter, application is allowed in terms of prayer clause (B).

Parties to appear before Family Court at Dhule on 15.09.2025.
