The learned counsel for the petitioner submits that already, respondent No.3 has prepared the seniority list of the employees of the school wherein petitioner is serving. He further submits that there are vacant posts of School Education Extension Officer in the office of respondent No.2 Zilla Parishad. He prays that the Zilla Parishad may take effective steps to fill up the post/appoint the employee by promotion as per their seniority.

2] It is submitted that though various representations are given to the respondent Nos. 2 and 3, no steps are being taken to fill up the vacant posts by promotion.

3] We direct the respondent Nos. 2 and 3, to take steps to promote/appoint the employees on the vacant post as per the seniority, if the Rules and procedure provides to give appointment by promotion only. Such steps be taken as expeditiously as possible and preferably within six months from today. While taking steps to give promotion on the aforesaid post of School Education Extension Officer on the aforesaid posts, the

{2} 953 sr.no..odt authorities shall keep in mind that the petitioner is from VJ/NT-A category Orthopedically handicapped with 41% disability. 4] It is made clear that we have not expressed any opinion on merits of the matter and the concerned authority will take into consideration the seniority and take appropriate steps. 5] With the above directions, writ petition stands disposed of.
