Applicant apprehends arrest in C.R. No. 897 of 2022, registered with Rahuri Police Station, District- Ahmednagar, for offence punishable under section 420 read with 34 of the Indian Penal Code.

FIR is lodged by Shubham Pansare stating that accused Vijay Sale is serving in CRPF and he told that he is having good acquaintance with higher officers of said department. Accused persons in furtherance of their common intention lured informant and his companions namely Pravin Sudam Kusmude, Yogesh Ranath Kusmude and Shubham Sunil Rupnar under the pretext of giving them Government jobs. Accused persons at their house at Khadambe extracted amount of Rs. 2 lakhs i.e. Rs. 50,000/- each from informant and his Bhagyawant Punde

{2} 24-ABA-1665-2023 companions and at the house of accused at Delhi, in November2017, they extracted amount of Rs. 2 lakhs each from informant and his companions. Thus, accused persons cheated informant and his companions and extracted total amount of Rs. 8 Lakhs from them under the guise of giving them Government jobs. 3.

Heard learned advocate for applicant and learned APP for respondent-State. Perused the charge sheet. 4.

Accused No. 1/husband of applicant is already arrested and is released on regular bail. Charge sheet is filed in the present crime on 28.11.2022 and case is numbered as Regular Criminal Case No. 393/2022. In the charge sheet, only material against applicant is that she has accepted an amount of Rs. 2 Lakhs from informant as per say of her husband. Except this there is no material showing involvement of applicant in the present crime. Since investigation is complete and as nothing is to be recovered from applicant, her pre-trial custodial detention is not necessary.

In the result, application is allowed by confirming interim protection granted on 17.10.2023.
