Inspite of service of notice, none appears for the Respondent. 2.

The applicant-wife has approached this Court with a prayer to transfer the proceeding of HMP No. 223 of 2024 pending in the Court of learned Civil Judge, Senior Division, Sillod Dist. Aurangabad to the Court of learned Civil Judge, Senior Division, Chalisgaon Dist. Jalgaon. 3.

Learned Advocate for the applicant-wife submits that there are two children, aged around 10 and 12 years, out of the marriage, who are residing with the applicant-wife. It is difficult for her to travel to Sillod. There is no one to accompany her to attend the Court and it is for this

Ethape ( 2 ) 917 -MCA-370-2024 reason, he submits that, it would be in the interest of justice to transfer the proceeding to the Court of learned Civil Judge, Senior Division Chalisgaon.

Having heard the parties. This Court finds that it would be convenient to the applicant if the proceedings is transferred to the Court of learned Civil Judge, Senior Division Chalisgaon. 5.

In view of the same, application is allowed in terms of prayer clause (B).

After transfer, the learned Trial Judge shall try to dispose off the proceeding as early as possible and preferably within one year from the date of transfer.

The applicant shall not seek unnecessary adjournments. In case the Trial Court finds that the adjournments are unnecessarily sought, the Trial Court may deal with such application, so as to compensate the respondent-husband, if he personally remains present. 8.

With this, application stands disposed off.
